What's included

DNA Specimens and Data Unless a specific arrangement is agreed on in writing, the DNA specimens and/or the DNA profile data obtained from the DNA specimens are accessible by you, the customer, who had ordered the service through the GeneTree web site or third party reseller.
Communication GeneTree, by default, is an opt-out site. You will receive communications from us unless you opt-out of these messages. By providing GeneTree your contact information, including your email address, you consent to GeneTree using the email address to send you Service-related notices, including among other things notices required by law, in lieu of postal mail. You may not opt out of Service-related e-mails. GeneTree may also use your email address to send you other messages, including messages from other GeneTree members, changes to GeneTree site features and special offers. If you do not want to receive such email messages, you may opt out by changing your account preferences. Ordering Via Third Party Resellers By providing GeneTree your information via third party resellers, you consent to GeneTree using this information to generate, on your behalf, a registered user account with the GeneTree web site. You will receive an email to create a password in order to access your GeneTree user account. Your GeneTree account is used for communicating with you regarding your DNA kit status, DNA test results and questions.
Terms and Conditions for Services Offered
1. Interpretation
In these conditions, the following words have the following meanings:
"GeneTree" means GeneTree, a division of Sorenson Molecular Genealogy Foundation.
"Contract" means any contract between GeneTree and the Customer for the supply of the Services incorporating these conditions.
"Services" means the provision of a DNA analysis from biological samples the Customer provides to GeneTree.
"Customer" means the person who requests Services from GeneTree.
2. Provision of Services
2.1 The DNA analysis provided by GeneTree is prepared solely for the use of the Customer who placed the order in the GeneTree system. GeneTree makes no representation, express or implied, that the result of the DNA analysis is fit for any purpose other than providing a genetic comparison between biological samples supplied to GeneTree by the Customer.
2.2 The biological samples supplied to GeneTree by the Customer are unrecoverable due to the laboratory procedures required to extract DNA.
2.3 GeneTree reserves the right to use any third party of its choice to undertake the laboratory services for the DNA analysis.
3. The Customer's Warranties and Indemnity
3.1 The Customer warrants that he/she is legally entitled to perform any particular act either directly or indirectly in order to obtain the biological samples and supply them to GeneTree for analysis.
3.2 The Customer warrants that he/she is legally entitled to possession of the biological samples provided to GeneTree.
3.3 The Customer will indemnify GeneTree and keep GeneTree fully indemnified against all costs, claims, demands, expenses and liabilities of whatsoever nature arising from a breach of the warranties in 3.1 or 3.2.
4. GeneTree's Disclaimers and Liabilities.
4.1 GENETREE DOES NOT WARRANT TO CUSTOMER: (A) THAT THE SERVICES PROVIDED BY GENETREE WILL MEET THE EXPECTATIONS OF THE CUSTOMER; OR (B) THAT GENETREE'S SERVICES WILL BE FREE FROM DEFECTS OR FREE FROM ERRORS.
4.2 FURTHER, IN NO EVENT SHALL EITHER GENETREE OR THE CUSTOMER BE LIABLE TO THE OTHER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER.
5. Third Parties
A person who is not the Customer or GeneTree has no right under the Contracts (Rights of Third Parties Act 1999) to enforce any term of these Terms and Conditions but this does not affect any right or remedy for a third party which exists or is available apart from that Act.
6. Governing Law
The construction, validity and performance of these Terms and Condition shall be governed in all respects by Utah, USA Law and be subject to the exclusive jurisdiction of the Utah, USA Courts.
